Terms of service
- On request of W2W to try and sell your items you are legally accepting to these conditions.
- All items are genuine and not counterfeit
- W2W reserves the right to only sell what they believe to be in alignment with their business model.
- Any items which W2W believe to be counterfeit or unsellable on the W2W site will be returned to the customer (at the cost to the customer).
- On receipt of items; W2W will send an inventory of what has been received and a Minimum and Maximum amount that we will sell an item for (customers get 48 hours to dispute any errors).E.G. Red All Saints dress. W2W price £70 however if we need to reduce it then the lowest figure we will sell for is £50. (figures will vary, this is purely for example).
- When a customer sends their items to W2W they are hereby accepting that W2W has the authority to use their market knowledge to decide on the commercials as regards to a selling price unless otherwise specified.
- You are agreeing for W2W to post any items on social media, 3rd party marketplaces and the W2W website to help sell the items.
- At the end of the selling period (Maximum of 3 months from the date W2W took delivery of the clothes) an email will be sent out with a breakdown of what each item sold for minus 45% commission. The payment will be sent directly to your bank account.
- Any clothes that haven’t sold can either be returned to you (at the cost of the customer, this will be deducted from your final payment) or given to a local charity. Any items that are unfit for sale due to flaws, damage, alterations been made to an item will not be accepted and will be returned to you at the cost to the customer or donated to charity. An email will be sent to explain why these items are unsellable.
- Every care will be taken of your items, however Wardrobe2Wardrobe cannot accept any liability for loss or damage.
- By accepting to these Terms & Conditions, you agree to Royal Mail's Terms and conditions, including their prohibited and restricted items policy. The client takes full responsibility. - Small Parcels must NOT exceed 2KG. Medium Parcels must NOT exceed 20KG, Large parcels must NOT exceed 30KG. It is the clients responsibility to pay any excess.
Using Wardrobe2Wardrobe as an agent to sell:
We accept:
*High Street Brands (i.e. NEXT, RIVER ISLAND, ZARA etc) These must be NEW WITH TAGS and a resale value of over £20.
* Premium High street clothing (i.e. KAREN MILLEN, REISS, WHISTLES etc) These items must be excellent condition and have a resale value of over £20.
*Designer Brands – All items must be clean and in an excellent selling condition.
We rely on a prompt turnover of stock and therefore cannot accept any items that do not meet the above criteria.
Some higher end priced items may be kept for longer than the 3-month period. After the 3-month period the items may be reduced periodically to reflect seasons/ sales etc. However, should you wish for the items to be sent back to you please send an email to specify this.
It is the seller’s responsibility to request the items back via email and a return fee of £8 per item will be charged to cover postage / admin etc.
Ownership:
The owner of the items guarantee that they are the lawful and true owner of any items they consign to Wardrobe2Wardrobe. You agree to indemnify and hold harmless Wardrobe2Wardrobe for any damages arising from any or all claims, demands, losses, causes of action, damage, lawsuits, judgements, including legal fees and costs, to the extent caused by or arising out of or relating to any unlawful ownership. You, the owner agrees that the selling price is minus Wardrobe2Wardrobe’s agreed commission. You agree that the title does not at any stage pass to Wardrobe2Wardrobe and remains with you, the owner throughout.
Authenticity:
Wardrobe2Wardrobe only accepts authentic designer items. As the owner of these pieces you guarantee the authenticity of the items.
Wardrobe2Wardrobe must ensure all items are authentic. If we identify a piece that is high risk, we may request for you to confirm the authenticity of the item and where possible if you have a receipt/ proof of purchase please send this along to us.
If an item is delivered to Wardrobe2Wardrobe that are deemed to be counterfeit by Wardrobe2Wardrobe or a qualified 3rd party they will be returned to you (to the cost of the customer). In the unlikely event that you receive payment for an item that is later deemed to be counterfeit you agree to repay the full amount received plus any other loss associated with its sale and return.
Pricing:
Wardrobe2Wardrobe reserve the right to determine the final selling price of the items. The price will be determined by taking the original RRP / Current Selling/ Last selling, brand, style, condition and the current market demand for the item into account. Wardrobe2Wardrobe will, at all times attempt to achieve the highest possible price for sale. If you (the client) wish to specify a selling price then please do so in email within 48 hours ofWwardrobe2Wardrobe receiving the items.
Collection of the Items:
After the 3 month period (or longer if specified) you will be given the option of either
A, requesting the items which have not sold to sent back to you (at the cost to the customer) OR
B, you give Wardrobe2Wardrobe the authority to give the clothes that have not sold to a charity.
Failure to reply will automatically mean the clothes that have not sold will be given to charity.
Termination:
The seller has the right to revoke authorisations granted to Wardrobe2Wardrobe in these Terms of Service at any time in writing. Please ensure all requests are sent via email. The cancellation becomes effective upon receipt by Wardrobe2Wardrobe.
In this unlikely situation, Wardrobe2Wardrobe remains the right to continue to sell any items that are already listed on the W2W website or any 3rd party site. The cost of the return of such items remains with the seller.
Data Privacy:
We comply with the legal requirements when collecting storing and processing the users personal data.
All sellers’ data are kept confidential. Each seller is given a client number.
Wardrobe2Wardrobe respect the sellers privacy. All items / transactions are kept confidential between the seller and Wardrobe2Wardrobe.
